These Terms & Conditions (“Terms”) govern your access and use of Team Spy (“Service”, “we”, “our”, “us”). By accessing or using Team Spy, you agree to these Terms. If you do not agree, you must stop using the Service.

These Terms apply to:

  • Clients / Employers who purchase and manage the system

  • Employees / Users who use the application or are monitored by it


1. Definitions

  • “Client” refers to the business or organization that purchases or uses Team Spy.

  • “User” means employees or individuals using the system under the Client’s account.

  • “Service” refers to the Team Spy employee tracking and productivity monitoring software.

  • “Data” means any information collected, stored, or processed by the Service.


2. Acceptance of Terms

By using the Service, you confirm that:

  • You are at least 18 years old

  • You are authorized to use the system (as Client or User)

  • You agree to comply with all applicable laws and these Terms

Clients are responsible for ensuring all employees or monitored individuals are informed about the Service.


3. Service Description

Team Spy provides:

  • Employee activity monitoring

  • Attendance and time tracking

  • Productivity analytics

  • GPS and location tracking (if enabled)

  • Screenshots and screen activity (optional settings)

  • Task and workflow management

  • Reporting and dashboard tools

Features may vary based on subscription plan or customization.


4. Account Registration & Responsibilities

4.1 Client Responsibilities

Clients must:

  • Provide accurate information during registration

  • Maintain account security and confidentiality

  • Ensure employees are informed about monitoring

  • Use the Service in compliance with local labor and privacy laws

  • Not misuse the platform for illegal surveillance

4.2 User Responsibilities

Users must:

  • Use the system only as authorized by their employer

  • Not attempt to bypass or disable monitoring modules

  • Not misuse the platform or interfere with its operation


5. Permitted & Restricted Use

5.1 Permitted Use

You may use the Service for:

  • Employee productivity management

  • Attendance verification

  • Monitoring company-issued devices

  • Improving workflow efficiency

5.2 Restricted Use

You may not:

  • Use the Service for spying on individuals without consent

  • Track personal devices without permission

  • Reverse-engineer, hack, or disrupt the system

  • Upload harmful, illegal, or malicious content

  • Use the platform for activities violating privacy or labor laws

Unauthorized use may result in account termination and legal action.


6. Data Collection & Processing

Team Spy may collect:

  • Location data

  • Device information

  • Activity logs

  • Screenshots (if enabled)

  • Network and usage details

The Client owns all employee monitoring data.
Team Spy acts as a data processor/service provider, handling data strictly for service delivery.

7. Subscription, Payments & Refunds

  • Service is billed on a subscription basis (monthly or yearly).

  • All fees must be paid in full before accessing features.

  • Clients authorize us to charge the payment method on file.

  • Refunds are subject to our Refund Policy (can be added separately).

  • Pricing may change, and notice will be provided in advance.

Failure to pay may result in suspension or termination of the account.


8. Intellectual Property

  • All software, code, design, tools, and content remain the exclusive property of Team Spy.

  • Clients receive a limited, non-transferable, non-exclusive license to use the Service.

  • You may not copy, modify, redistribute, or resell the software without permission.


9. Service Availability & Updates

We strive to maintain 24/7 uptime but do not guarantee:

  • Uninterrupted access

  • Error-free performance

  • Zero data loss

We may update or modify features, system design, or functionalities at any time.


10. Termination

We may suspend or terminate access if:

  • The Client violates these Terms

  • Payment is not completed

  • Illegal or unauthorized use of the platform is detected

  • There is misuse affecting system performance or security

Clients may terminate their subscription by contacting support.

Upon termination:

  • Access to the system may immediately end

  • Data may be deleted as per the retention policy


11. Liability & Disclaimer

11.1 No Warranty

The Service is provided “as is” and “as available”, without warranties of any kind.

11.2 Limitation of Liability

We are not liable for:

  • Loss of data

  • Business losses

  • Financial damages

  • Misuse of the Service by Clients

  • Legal or regulatory issues resulting from improper monitoring by Clients

Clients are responsible for using Team Spy ethically and legally.


12. Compliance with Laws

Clients must ensure:

  • Monitoring is allowed under local labor, privacy, and data protection laws

  • Employees are informed of being monitored

  • Consent is obtained where required (e.g., GPS tracking)

Team Spy is not responsible for legal violations by Clients.


13. Third-Party Services

The Service may integrate with third-party tools such as:

  • Cloud hosting providers

  • Payment gateways

  • Analytics tools

We are not responsible for any issues caused by third-party services.


14. Modifications to Terms

We may update these Terms at any time.
Continued use of the Service after changes constitutes acceptance of the revised Terms.


15. Governing Law

These Terms will be governed by and interpreted according to the laws of:

India

Disputes will be resolved in the appropriate courts of this jurisdiction.
